1. Acceptance

By accessing or using Emerge Tech ("the platform") at www.emergetech.online, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not access or use the platform. We reserve the right to refuse service to anyone for any reason at any time.

2. Use of the Platform

You agree to use the platform only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. You are solely responsible for the accuracy and quality of any content you submit (including startup profiles, product submissions, and other materials). You warrant that all information provided is true, accurate, and complete.

You agree not to use the platform to:

Harass, threaten, defame, or abuse other users or third parties
Infringe or violate any intellectual property, privacy, or contractual rights
Attempt to gain unauthorized access to our systems, databases, or other users' accounts
Engage in automated scraping, crawling, or data collection without permission
Transmit viruses, malware, or any code of destructive nature

3. Accounts & Content

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree not to share your credentials with any third party and to notify us immediately of any unauthorized use. You are fully responsible for all actions taken through your account.

You retain all ownership rights to any content you submit. By submitting content to the platform, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your content in connection with operating, marketing, and improving the platform and our services.

We may remove content that violates these terms or is otherwise objectionable. We reserve the right to terminate any account that violates these terms or engages in prohibited conduct.

4. AI-Generated Content

The platform provides tools for generating content such as landing pages and other materials using artificial intelligence. All AI-generated content is provided "as is" without any warranty of accuracy, completeness, or suitability for a particular purpose.

You acknowledge that AI-generated outputs may contain errors, inconsistencies, or inaccuracies. You are solely responsible for reviewing, testing, and customizing any generated content before publishing or deploying it. We do not guarantee that AI outputs will meet your specific needs or expectations.

We are not liable for any decisions you make based on AI-generated content, or for any consequences arising from your use or publication of such content.

5. Product Submissions

Any product or startup submissions you make to the platform may be reviewed by our moderation team, including both automated systems and human reviewers. We reserve the right to reject, modify, edit, or remove any submissions that do not meet our guidelines or quality standards.

Products must have live, functional websites that are accessible to users. Submissions with broken links, non-functional content, or that do not meet platform standards may be rejected or removed.

By submitting a product or startup, you represent and warrant that you have the right to submit the content and that it does not violate any third-party rights.

6. Payments & Subscriptions

If you purchase a paid feature or subscription, you agree to pay all charges incurred. Paid subscriptions are billed on a recurring basis unless you cancel. By providing payment information, you authorize us to charge your payment method for all fees.

Cancellation of a paid subscription takes effect at the end of your current billing period. You will not receive a refund for any partial month or unused portion of your subscription. Refunds, if any, are issued at our sole discretion and subject to our refund policy.

We reserve the right to change pricing and billing terms with reasonable notice. Your continued use constitutes acceptance of new terms.

7. Intellectual Property

The platform, including all content, design, code, trademarks, and intellectual property, are owned by Emerge Tech or its licensors. You may not reproduce, modify, distribute, or transmit any platform content without our express written permission.

Content that you submit remains your property, but you grant us the rights described in Section 3. Third-party content on the platform is provided under license and subject to the terms of those licenses.

8. Disclaimers

The platform and all tools, features, content, and services are provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, secure, or free from viruses or other harmful code.

We expressly disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of the platform is at your own risk.

We are not responsible for decisions you make based on information or content on the platform, including AI-generated content, user-submitted content, or any other material. We are not liable for any loss or damage resulting from your reliance on platform content.

9. Limitation of Liability

To the fullest extent permitted by law, Emerge Tech and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or revenue, arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these terms shall not exceed the amount paid by you to use the platform in the twelve months preceding the claim, or if you have not paid any amount, then zero dollars.

10. Termination

We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, if we determine that you have violated these terms or engaged in conduct that is harmful, illegal, or otherwise objectionable.

Upon termination, your right to use the platform ceases immediately. You remain liable for any outstanding charges or obligations incurred prior to termination.

We may update these terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. Continued use of the platform after any changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
